Transfer of an economic unit: Requirements,effects and recent CJEU ruling 1

Abstract

The present paper intends to present the requirements on which the application of the transfer of an undertaking regulation depends. Therefore, it summarises the positive and negative conditions to be fulfilled – taking into account chiefly the Portuguese experience and other jurisdictions – followed by the identification of its effects and a brief analysis of the CJEU rulings from 2013 until 2017.
