The United States Department of Justice, Immigration and Naturalization Service mandates that employers, public or private, assist and cooperate in discouraging illegal aliens and aliens who do not have the right to work in the United States, from seeking employment. In New York State, for example, a standard question appears on the application form for employment designed to elicit information on alien status and to discourage illegal aliens or aliens not entitled to such employment from applying.
