Does UK Health and Safety Legislation Rely upon a Poorly-Resourced Enforcement Agency,a Limited Scheme for Employee Involvement,and a Misplaced Emphasis on Self-Regulation?

Abstract

This paper will examine specific provisions contained in the Health and Safety at Work Act (the Act) 1974, the primary domestic legislation governing health and safety in the workplace, as well as, the Management of Health and Safety at Work Regulations (MHSW) 1999. Are these statutes/regulations effective, and how have the courts interpreted/applied them?
