Although Black and other students of color, students with disabilities, and poor students in urban settings are, undeniably, linked to the educational inequities they have experienced in the United States educational system, few attempts have been made to examine the intersection of the historic Brown decision on students with disabilities and their use of Brown to secure their “Equal Protection Under the Law” with respect to educational rights. This paper provides a historical overview of Brown and its impact, successes, challenges and the work that remains.
