Lynne Brindley was a tireless advocate in the UK for a system of copyright fit for the digital age. This article describes the German situation for orphan works and out-of-print works in the light of the recently published European Directive (2012/28/EU). The author argues that a modern copyright framework which applies to the digital world is urgently needed that takes into account the different needs of each stakeholder.
