Abstract
This article discusses the role of robust and efficient payment and settlement systems as an integral part of the financial infrastructure. It examines some of the legal and regulatory issues concerning the development of such systems. In particular, the ways in which legal risk in a payment and settlement system can be reduced are explored. Issues relating to the use of collateral in a payment and settlement system and disaster recovery approaches to prevent and recover system failures are also briefly discussed.
