Abstract
Controversies raised by the Alder Hey Inquiry have focused public attention on post-mortem examination and retention of human tissue as well as the requirement for pathologists to obtain proper consent. To address these issues in Scotland, the Human Tissue (Scotland) Act 2006 (HTA) came into force in September 2006. This Act identifies persons who may authorise the removal and use of the body. However, controversy persists regarding the status of the stillborn and the practical problems of obtaining authorisation for post-mortem examination. Amendments to the HTA may follow. The aim herein is to select specific aspects of the law where difficulties arise in practice and also illustrate efforts towards resolution, for debate and discussion.
