Legal Effects of Directives Amending or Repealing Pre-Lisbon Framework Decisions

Abstract

The Treaty on the Functioning of the European Union does not know the category of Framework Decisions any more. Nevertheless Framework Decisions “survived” the entry into force of the Lisbon Treaty due to transitional regulations in Protocol No. 36. This paper discusses unsolved questions which arise when directives under the TFEU amend or repeal Framework Decisions. This is especially important when it comes to considering the direct effect of the amended Framework Decisions.
