The ERG Common Position on Remedies under the New Regulatory Framework for Electronic Communications: An Economist's Perspective

Abstract

The recently published ERG Common Position on remedies under the new regulatory framework for electronic communications has been received by many observers and industry actors as a very intricate and at times impenetrable document. However, while clearly being very dense, it is a particularly important contribution to the evolution of the new framework, as well as of regulatory policy in general. This is true not only because it provides a common reference tool for regulators, but also because, by drawing at the same time on their experience and on economic analysis, it builds a much needed bridge between the two. This paper offers an interpretation of the main concepts behind the document and attempts to clarify the reasons why it can be of great support in the process of harmonising regulatory intervention across the EU.
