Abstract
The legal reasoning, case law and legislation relevant to negligence and gross negligence are discussed, using the case of a patient who developed shock after elective knee surgery. It highlights that there is individual and corporate accountability for negligence and is especially relevant given the recent investigation into Mid Staffordshire Foundation NHS Trust.
