Challenging Environmental Tobacco Smoke in the Workplace

Abstract

This article examines the law relating to passive smoking and focuses on the issue of occupational health and safety. Recent litigation in the United Kingdom, the United States and Australia is discussed against the backdrop of newly published medical research. Various means of challenging employers who acquiesce in the face of workplace tobacco smoke are considered in the main body of the article.
