Abstract
Modern technology affords employers a myriad of opportunities to monitor employees. While employers have a legitimate interest in measuring and evaluating workers’ performance, current electronic techniques raise equally legitimate concerns over employee privacy in the workplace. At present, there are a number of existing laws along with a small number of proposals under consideration in Congress. As one of the world's largest employers, it is incumbent on the hospitality/tourism industry to keep abreast of this issue. This article provides an overview of the competing interests of employers and employees in relation to electronic monitoring along with a summary of relevant laws and legislation.
