Abstract
Trademark protection is available for business names, signs, symbols and associated items. Today, hospitality operators are trying to expand trademark coverage to include restaurant concepts and decor, while also defending their marks from competitors seeking to imitate them. The paper analyzes some representative hospitality trademark cases and points to the expansion of hospitality industry trademark rights in the “McSleep” decision and in several cases involving trademark protection for restaurant concept and decor.
