Abstract
The First Amendment status of advertising and commercial speech is assessed by evaluating the influence of the 1986 Posadas decision on subsequent court cases. In conjunction with other cases, particularly the Fox case of 1989, Posadas served to weaken the degree of protection for advertising. Implicit in the courts' decisions since Posadas is that restrictions of truthful advertising for lawful products is more likely in the future.
