Abstract
The system of democratic regulation of privately owned utilities that has evolved in the United States over the past century includes five main elements: participation; transparency; a standard of justice and reasonableness; protection against confiscation of utility assets; and prices that are related to costs. After setting these elements forth and explaining how they are balanced, we describe how the system failed in a series of relatively small but highly visible experiments with deregulation in California and elsewhere in the US. Finally, we outline the history of how democratic regulation evolved in the US and how democracy is reversing the failed experiment with deregulation in California.
Le système de réglementation démocratique des services économiques d'intérět général privatisés qui a évolué aux Etats-Unis durant le siècle passé comporte cinq éléments principaux: la participation, la transparence, une norme de justice et de bien fondé, la protection contre la confiscation des biens, et les prix qui sont liés aux coûts. Après avoir mis ces éléments en évidence et avoir expliqué la manière dont ils sont équilibrés, l'article décrit la manière dont le système a échoué dans un certain nombre d'expériences, relativement mineures mais hautement flagrantes, telles que la déréglementation en Californie et ailleurs aux USA. En dernier lieu, les auteurs décrivent l'évolution de la réglementation démocratique aux USA et la façon dont les principes démocratiques ont permis de renverser une expérience râtée de déréglementation en Californie.
Das Modell der demokratischen Regulierung von privaten Versorgungsgesellschaften, das sich in den Vereinigten Staaten im letzten Jahrhundert entwickelt hat, weist fünf wesentliche Elemente auf: Beteiligung, Transparenz, das Gerechtigkeits- und Angemessenheitsprinzip, den Schutz vor Beschlagnahmung von Vermögenswerten der Versorgungsbetriebe sowie Tarife, die im Verhältnis zu den Kosten stehen. Zunächst beschreiben wir diese Elemente und erläutern, wie sie miteinander ins Lot gebracht werden. Anschlieβend gehen wir dem Scheitern dieses Modells am Beispiel von einer ganzen Reihe von kleinen aber sehr öffent-lichkeitswirksamen Experimenten mit der Deregulierung in Kalifornien und anderswo in den USA auf den Grund. Und schlieβlich befassen wir uns mit der historischen Entwicklung der demokratischen Regulierung in den USA und zeigen auf, wie mit demokratischen Mitteln das misslungene Deregulierungsexperiment in Kalifornien wieder umgekehrt wird.
