The ‘hands off doctrine’ defined the relationship between the federal courts and departments of corrections. The doctrine remained securely in place until the 1960s and 1970s when the actions combined with exceptionally poor prison conditions in Alabama and Arkansas combined to breech the doctrine. Once the doctrine was breached, violations of the full range of constitutional rights became causes of action for inmates.
