Abstract
This article addresses the provision of the American Recovery and Reinvestment Act of 2009 (ARRA) requiring an employer to subsidize an employee’s premiums for continued group health insurance pursuant to the Consolidated Omnibus Budget Reconciliation Act (COBRA). The article discusses who qualifies for the subsidy, how the subsidy works, the recovery of premium subsidies, notice requirements to employees, election of different coverage options and the law’s impact on pre-existing condition limitations. The article also discusses what employers need to be doing with respect to the COBRA provisions of ARRA, and possible further changes to health care coverage for employees.
