Abstract
With reserve and National Guard units called to service in the wake of the terrorist attacks of September 11 and the subsequent declaration of a national emergency by President Bush, employers must recognize the special employment rights of their employees serving in the military. The law governing military service as it affects employers and employees is the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA). It provides for military leaves of absence and reemployment of eligible employees when they return from military leave. USERRA also protects employees and job applicants from discrimination because of their military service. To comply with the law and help their employees manage through this challenging time, employers need to be fully informed of what the law requires. Be prepared: If you have not looked at this law recently, you may be surprised to discover that USERRA goes beyond what might be expected in many instances.
