The study focuses on the complexities of providing extended school year services (ESY) to students with handicaps within the legal framework of Public Law 94-142 and Section 504. Issues addressed in the literature, especially in the areas of litigation and legislation, were used to examine current state ESY policies. Recommendations for the development of an ESY policy reflecting current trends based on data collected from state educational agencies and a review of the literature are provided.
