Abstract
Videotaping forensic evaluations challenges clinicians to consider potential ethical dilemmas and logistical questions. Obtaining informed consent prior to videotaping from a potentially incompetent individual is one flashpoint that illuminates these matters. In developing the best response, clinicians must look beyond the limited case law and include other resources such as published ethical opinions and standards issued by health-care regulators, licensing boards, and professional organizations. A legal request to videotape a forensic evaluation should not result in a resolute refusal, but instead a qualified approval that reflects a thoughtful, structured response balancing medical and legal interests.
