Abstract
The rights of transgender students in U.S. schools are getting a lot of press. A guidance document set forth by the U.S. Departments of Justice and Education advises schools to treat all students consistent with their professed gender identity. However, there have been several recent challenges to the document. In the midst of this legal swirl, schools and educators in states that prohibit gender identity discrimination should follow state laws and policies. All educators are advised to consult with their district’s attorney regarding the most appropriate path for their jurisdiction.
