Abstract
The law of Scotland in regard to insanity induced by drink or drugs is considered in the context of the opinion of seven judges in Brennan's case. Reference is made to the views expressed in the English House of Lords decision in Majewski, also from seven judges.
An assessment of legal insanity is given and some medical points noted. Tentative conclusions are suggested.
