Abstract

Prosecution of the lesser offender is usually begun by arrest. Few states permit the police officer at the scene of the offense to issue a "notice to appear" instead of making an arrest, except for traffic and regulatory offenses; even in those states where "notice to appear" is authorized by statute for wider application,'it is sel dom used.
